This letter was dated 15th May 2011, was posted second class on the 20th May 2011, and the letter was received on the 23rd May 2011.

Dear Sir/Ms
You are hereby formally requested to cease and desist the cctv coverage of my personal private property/space from the property known as 26 Perkhill Road. None of the lower ground area nor the back shed is owned, in whole or in part, as part of the property known as 26 Perkhill Road. It is a violation of my personal human rights to have my privacy contravened in this way and an act for which I can involve the police. The crime number will then be used in the future court action.

If this request is not carried out within 1 week I will commence court action against you.

Sincerly Yours

Ian A. Nicol

The following letter was from a solicitor at Aberdein Considine dated 23rd May 2011, and was received on the 24th May 2011:

CCTV at 26 Perkhill Road

We act on behalf of Mr Nicol who has been in contact with us regarding your installation of a CCTV system direct at his property.

Mr Nicol is extremely concerned that the cameras have been installed in an offensive manner in order for you to view his property. As such this is an intrusion on his property which is restricting his use and enjoyment of his property and is a breach of Mr Nicol’s privacy.

We therefore require you to take down the CCTV system within the next 7 days, which failing we are instructed to take court action.

In the meantime, this letter is written purely entirely without prejudice to our client’s whole rights and pleas in law and may only be founded upon at their express or implied consent in any future or contiguous litigation.

Yours sincerely

Signature illegible

My grandfather John Edward Gordon was born in Lumphanan in 1917. His parents lived in Loanend and Orton cottage, Burnside for many years upto the early 1900′s by the 1911 census they had moved to Hirley, Aboyne. Just before the 2nd world war my grandfathers mother had passed away and he joined the RAF. He ended up in Gainsborough, Lincolnshire after the war where he had a family and remained until his death in 1991.

After the war had finished he never returned or spoke about his family in scotland, even to his son my father. I have tried to track down any remaining family members and I have created a family tree but it only goes upto the last released census in 1911.

My grandfather parents were

Charles Gordon 1893 – 1955, Jessie Gordon (Geddes) 1875 – 1934

He had brothers and sisters

Charles (1901 – 1982), Georgina (1903-1985), William (1908 – 1994) & Cecelia (1912 – 1990)

If anyone has any information regarding this part of my family, I would be grateful if you could pass it on.

Thankyou

Dear fellow community council members,

Is it possible for me to have a copy of the LCC constitution and community councillors handbook and also minutes of meeting/s concerning myself and Lumphanan Forum?

Failing that, an account from some of the members on the details of allegations, which I believe had been proffered by Ian Nicol. It was said Mr Nicol could not defend himself regarding the article on the cctv camera.

The fact is I had told him to his face that he was breaking the law on a few counts.

He then put up a sign which contravened the law on a number of points, on that day I photographed the camera and the signage.

I then posted it on Lumphanan Forum.

Read the article.

If you feel you can be bothered making a comment go ahead…..

If you dont like me, even better!

I invite anybody to register and say their piece or post a picture. Click on reply to comment, then click register.

It would appear that Messrs Raeburn Christie Clark & Wallace currently act for you in the preparation of the title and accordingly in the first instance you should intimate any complaint to them. I would assure you that we are giving Raeburn Christie Clark & Wallace every co-operation insofar as we can in providing a fresh deed but I would stress that the responsibility for drafting the deed lies with that firm.
Yours sincerely

My Late Mother, purchased 26 Perkhil Road, Lumphanan on the 8th July 2010. The property was paid for, yet her name is not on the Title Deeds.

After talking to the Land Registry, I was told that the Title No ABN19528 had been split up, they also told me that Raeburn Christie Clarke & Wallace had not sent back the Transfer of Title. Mike Taylor of Raeburn Christie Clarke & Wallace, responded to my email, and he is of the understanding that it is yourselves, Aberdein Considine that is responsible.

I am making a formal complaint regarding the lack of “due dilligence”, or the “deliberant lack of due dilligence”, or the “miss-selling of property”, during the whole process of selling 26 Perkhill Road, to my Late 70-year-old Mother.

Why have yourselves, Aberdein Considine, not sent back the Transfer of Title? Why is my Mother’s name not on the Title Deeds for 26 Perkhill Road?

The attached pdfs (also on www.aberdeenshire.gov.uk/planning), regarding the planning application, for the plot adjacent to 26 Perkhill Road, suggests that Pauline Ross/Robertson knew there was a problem regarding the property. Mr Nicol (of 2 Millan Cottages, Lumphanan) made a general comment regarding the planning application on the 11th June 2006 (see attached). He did not mentioned anything regarding an error in the planning application.

Why wasn’t my Mother told about the alleged error on the Title Deed ABN19528, updated 25th November 2002?

Why didn’t the Aberdein Considine Property Schedule and the Home Report by JE Shepard match the Title Deeds for 26 Perkhill Road?

Why wasn’t my Mother told about the Asbestos?

Mr Considine spoke to Mr Morrison (my partner’s solicitor) regarding the purchase of the plot adjacent to 26 Perkhill Road, and he told Mr Morrison about the alleged error, that was allegedly just noticed, on the 6th September 2010. With reference to the Land Registration Act 1979, I believe that you have a responsibility for notifying the Land Registry, when noticing a competing title. Why was this not done when yourselves, Aberdein Considine and Mr Considine, noticed the error?
